    Courts Make Way for Medical Cannabis Commission to Move Forward

    Alabama Appeals Court Lifts Restraining Order on Medical Cannabis Commission

    In a major development for Alabama’s medical cannabis industry, the state’s Court of Civil Appeals has lifted the temporary restraining order (TRO) that had stalled the Medical Cannabis Commission’s licensing process.

    The TRO had previously prevented the commission from moving forward, leaving businesses like Joey Robertson’s Wagon Trail Med-Serv in limbo. Robertson, awarded an integrated license, has been waiting to open dispensaries where patients can access much-needed medicine. “It’s been tough, but worth it,” he said, emphasizing his eagerness to serve patients.

    The legal battle began over a year ago when Alabama Always sued the commission, claiming the licensing process failed to follow proper procedures. Now, with the TRO lifted, the commission is set to move forward. John McMillan, director of the Alabama Medical Cannabis Commission, expressed optimism. “This puts us in a position to do exactly what we’ve been preparing for over the past 15–16 months.”

    The decision also paves the way for investigatory hearings, allowing rejected applicants—like Alabama Always—to argue their case for a license. Attorney Will Somerville, representing Alabama Always, views the ruling as a victory for transparency and fairness. “The court made clear that the Alabama Administrative Procedures Act applies, and it must be followed moving forward,” he said.

    With an upcoming circuit court hearing scheduled for April 17, all eyes are on the next steps. As McMillan stated, “We’re just grateful that patients, doctors, and everyone involved can finally move forward.”
